Why does the agent have to agree when a maker registers their personal directive?
When makers register their personal directive with the Personal Directives Registry they also provide confidential information about their agent(s). Alberta privacy laws (
FOIP
and
PIPA
) require that each agent must be informed that their information will be viewed by professionals, who have been approved by the Office of the Public Guardian, to search the Registry. Each agent must first agree to their information being shown in the Registry before their information can be viewed.

If a maker can enter contact information about an agent why can a maker not change it later?
While a maker or a third party can register a personal directive with the Personal Directives Registry, privacy laws in Alberta (
FOIP
and
PIPA
) require that personal information entered in the personal directives must be consented to by the people who are named in the personal directive. After this consent is given, only the person whose information needs to be updated can update that information.

What happens if an agent moves?
It is the responsibility of the agent to update their contact information when there are changes. No one else can update the information on behalf of the agent because of Alberta privacy laws (
FOIP
and
PIPA
). It is important for the maker to remind the agent to update their contact information on the Registry when updates are needed so that the information on the Registry is always current.

What happens if a maker changes agents?
When a maker writes a subsequent personal directive and chooses different agents, the maker can enter the contact information of the new agent(s) and remove the previously named agents. The Registry would notify the previously named agents that the maker has removed them as their assigned agent on the Registry. The new agents would have to agree before their contact information becomes visible on the Registry.
